Amendment 14, Section 1 of the United States Constitution
- The Equal Protection Clause :

" All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. "

The Equal Protection Clause - Amendment 14, Section 1 of the United States Constitution is the provision that empowers the federal government to provide for and regulate the education of our children.

The federal government is involved in national teacher certification, educational curricula, textbook selection, learning standards, comprehensive sex education, psychological and psychiatric research testing programs, and personnel.

Education should be free from the federal government. All current federal legislation related to taxing education should be repealed. No new federal laws subsidizing or regulating education should be enacted.

Equitable tax relief for families whose children do not attend government schools should be provided for.

Education which drives improvement through nontraditional options such as internet based schools, charter schools, Christian and private schools, as well as home schooling options should be supported.

The unimpeded right of parents to provide for the education of their children in the manner they deem best, including home, private or religious.

Compulsory attendance laws should be repealed. Parents need not defy the law by refusing to send their children to schools of which they disapprove.

All legislation from any level of government that would interfere with or restrict that liberty should be opposed.

One size fits all education, as mandated by the Department of Education, is holding America’s children back.

Because control over education is now being relegated to departments other than the Department of Education, no federal agency, department, board, or other entity may exercise jurisdiction over any aspect of children’s upbringing. Education, training, and discipline of children are properly placed in the domain of their parents.

Education should be chosen to fit the needs of each child and situation and teachers, parents, and students should be able to make their own choices. They are far better able to assess the needs of a particular child than an agency far off in Washington.
